God vs. the Gavel challenges the pervasive assumption that all religious conduct deserves constitutional protection. While religious conduct provides many benefits to society, it is not always benign. The thesis of the book is that anyone who harms another person should be governed by the laws that govern everyone else - and truth be told, religion is capable of great harm. This may not sound like a radical proposition, but it has been under assault since the 1960s. The majority of (...) academics and many religious organizations would construct a fortress around religious conduct that would make it extremely difficult to prosecute child abuse by clergy, medical neglect of children by faith-healers, and other socially unacceptable behaviors. This book intends to change the course of the public debate over religion by bringing to the public's attention the tactics of religious entities to avoid the law and therefore harm others. (shrink)

Research ethics committees—animal ethics committees for animal-based research and institutional research boards for human subjects—have a key role in research governance, but there has been little study of the factors influencing their effectiveness. The objectives of this study were to examine how the effectiveness of a research ethics committee is influenced by committee composition and dynamics, recruitment of members, workload, participation level and member turnover. As a model, 28 members of AECs at four universities in western Canada were interviewed. Committees (...) were selected to represent variation in the number and type of protocols reviewed, and participants were selected to include different types of committee members. We found that a bias towards institutional or scientific interests may result from a preponderance of institutional and scientist members, an intimidating atmosphere for community members and other minority members, recruitment of community members who are affiliated with the institution and members joining for reasons other than to fulfil the committee mandate. Thoroughness of protocol review may be influenced by heavy workloads, type of review process and lack of full committee participation. These results, together with results from the literature on research ethics committees, suggested potential ways to improve the effectiveness of research ethics committees. (shrink)

Many large corporations now have written codes of ethics to guide the business/marketing activities of employees. The purpose of this study was to determine the frequency and types of topics which are covered in the ethics policy statements of large U.S. corporations. The results indicated that the topics covered most often (respectively) were: misuse of funds/improper accounting, conflicts of interest, political contributions, and confidential information. As the expansion of the Internet and the digital formatting of all kinds of creative works move us further into the information age, intellectual property issues have become paramount. Computer programs costing thousands of research dollars are now copied in an instant. People who would recoil at the thought of stealing cars, computers, or VCRs regularly steal software or copy their favorite music from a friend's CD. Since the Web has no national boundaries, these issues are international concerns. The contributors-philosophers, (...) legal theorists, and business scholars, among others-address questions such as: Can abstract ideas be owned? How does the violation of intellectual property rights compare to the violation of physical property rights? Can computer software and other digital information be protected? And how should legal systems accommodate the ownership of intellectual property in an information age? As part of a larger study eliciting Canadian producer and non-producer views about animal welfare, open-ended, semi-structured interviews were used to explore opinions about animal welfare of 20 Canadian pig producers, most of whom were involved in confinement-based systems. With the exception of the one organic producer, who emphasized the importance of a “natural” life, participants attached overriding importance to biological health and functioning. They saw their efforts as providing pigs with dry, thermally regulated, indoor environments where animals received abundant (...) feed, careful monitoring and where prospective disease outbreaks could be minimized and controlled. Emphasis was also placed on low-stress handling and agreeable working conditions which were believed to promote good animal care. The fact that pigs tend to respond to such conditions with steady growth reinforced the belief that good welfare was provided. Participants supported the use of sow gestation stalls, but with some reservations, and expressed concern about welfare problems that could occur if sows were grouped. Invasive procedures (castration, tail-docking, teeth clipping) were recognized as painful but were accepted because they were seen as: (1) necessary for sales or management; (2) satisfactory trade-offs to prevent worse welfare problems such as injury or infection; or (3) sufficiently short-term to be relatively unimportant. Participants were adamantly opposed to animal neglect and some welcomed actions of animal protectionists that expose poor care. Producers also welcomed natural-science-based approaches to improving animal welfare. The findings contribute to a broader effort to identify overlapping values among different stakeholder groups as a basis for formulating mutually agreeable, farm animal care and handling polices. ABSTRACTInitial acts of self-control can reduce effort and performance on subsequent tasks – a phenomenon known as ego depletion. Ego depletion is thought to undermine the capacity or willingness to engage executive control, an important determinant of success for many tasks. We examined whether ego depletion improves performance on a task that favours less executive control: insight problem solving. In two experiments, participants completed an ego-depletion manipulation or a non-depleting control condition followed by an insight problem-solving task. Participants in the (...) depleting condition demonstrated greater insight problem-solving accuracy than those in the non-depleting control condition. Priming theories of willpower did not impact these results. Although ego depletion is widely regarded as a “state of impairment”, attendant decreases in executive control may foster insightful thinking. (shrink)

Backround Education in ethics and professionalism should reflect the realities medical students encounter in the hospital and clinic. Method We performed content analyses on Case Observation and Assessments (COAs) written by third-year medical students about ethical and professional issues encountered during their internal medicine and paediatrics clinical clerkships. Results A cohort of 141 third-year medical students wrote 272 COAs. Content analyses identified 35 subcategories of ethical and professional issues within 7 major domains: decisions regarding treatment (31.4%), communication (21.4%), professional duties (...) (18.4%), justice (9.8%), student-specific issues (5.4%), quality of care (3.8%), and miscellaneous (9.8%). Conclusions Students encountered a wide variety of ethical and professional issues that can be used to guide pre-clinical and clinical education. Comparison of our findings with results from similar studies suggests that the wording of an assignment (specifying “ethical” issues, “professional” issues, or both) may influence the kinds of issues students identify in their experience-based clinical narratives. In the seventeenth century the new science was introduced through the works of Bacon, Hooke, Boyle, Power, and others. The advocates of the new science promised to divulge the inner workings of nature and to help man overcome his painful fallen state by means of controlling nature. The new sciences of mechanism and corpuscularism were to be based on objective experiments that would reveal the secret inner natures of minerals, vegetables, animals, the sun, moon, and stars. These experiments were done (...) with new and improved telescopes and microscope with magnifications of up to 100 times. One early critic of the new science was Margaret Cavendish. Cavendish was skeptical of the ambitious claims, methodology, instruments, and institutions of the new science. In her work, Observations Upon Experimental Philosophy, Cavendish argued against “experimental and dioptrical writers,” provided her own account of the natural world, investigated aspects of chemistry, medicine, and the nature of heat and color, as well as many other topics in natural philosophy (OEP 10). While many think Cavendish landed on the wrong side of history with respect to her skepticism regarding microscopes and telescopes, her criticisms of the new science were wide ranging and she was by no means the only one to question the value of such experiments and instruments. While several commentators, like Eve Keller (1997), have argued that Cavendish was against all things experimental, several recent commentators, Emma Wilkins (2014) and Deborah Boyle (2018), have tried to show the much more complicated relationship between Cavendish and the Royal Society and medical studies, respectively. In addition, some commentators, such as Lisa Sarasohn (1984, 2010) and Eve Keller (1997), have argued that Cavendish’s criticisms of the new science are based on her belief that Nature, as a representation of the feminine, was under attack by the experimentalists desire to “penetrate” and “manipulate” her for their own ends. While it is certainly true that Cavendish and many of the experimentalists personified nature as a woman, and that Cavendish does portray the men as trying to make her into something she is not, I agree with Deborah Boyle (2004) that these descriptions are not the focus of her objections to experimentalism. Rather than hold that Cavendish is concerned with, as Sarasohn claims, “the sexual implications for both women and nature of the new philosophy” (2010: 147), it seems that Cavendish’s objections were largely based on her philosophical commitments. However, I believe there is one aspect of the new science that Cavendish does critique from a feminist perspective, and that is what she sees as its institutional nature and its exclusion of women on the basis of sex, and to this I will turn in the last section of the chapter.1 My aim is to address Cavendish’s three major critiques of the new science. The chapter is divided as follows: The first section provides a brief overview of Cavendish’s views on the nature of bodies and perception. The second regards her critique of the methods and aims of the new science as represented by Bacon and Boyle. The third section examines her critique of Hooke and the instruments of experimentalism. The final section lays out her feminist critique of the institution of the new science. (shrink)

This book is an examination of the metaphysical systems of Margaret Cavendish and Anne Conway, who share many superficial similarities. By providing a detailed analysis of their views on substance, monism, self-motion, individuation, and identity over time, as well as causation, perception, and freedom, it demonstrates the interesting ways in which their accounts differ. Seeing their systems in tandem highlights the originality of each philosopher. In addition to providing the details of their metaphysical views, the book also shows how they (...) put these views to use: for Cavendish in grounding her natural philosophy and for Conway in developing her theodicy. The account of Cavendish is more naturalistic than current interpretations. It argues that God plays no substantive role in Cavendish’s philosophy. The book provides an account of Cavendish’s matter and her biological holism. It shows how sensitive and rational matter are expressed differently in different natural kinds. It provides the first account of Cavendish’s views on individuation and identity over time and a detailed account of her views on causation, arguing that nature is the only principal cause. The book also provides an account of Conway’s spiritual substance, arguing that it is a unique type of substance. It discusses Conway’s two types of motions and causation. In addition, a detailed account of her view of motion as a mode of body, and how it is transferred, is provided. Finally, the book concludes that Conway’s metaphysics and morality are inseparable and that she holds a type of perfectionism. (shrink)

We examine the implications of the US government’s too-big-to-fail policy as it has been applied to banks. Using alternative measures of risk, we compare the risk-taking behavior of 11 TBTF banks, identified by the Comptroller of the Currency in 1984, to a number of non-TBTF banks. We provide both theory and new empirical evidence to support our argument that the TBTF policy leads management to significantly increase risk-taking, with no corresponding increase in performance. While prior studies have considered the effects (...) of the TBTF policy on limited, but risk-related aspects of bank behavior, such as the cost of funds, our study provides direct evidence about the risk-taking behavior associated with the TBTF policy. Our study has important implications for the current political debate regarding the too-big-to-fail policy. (shrink)

Phase 1 healthy volunteer clinical trials—which financially compensate subjects in tests of drug toxicity levels and side effects—appear to place pressure on each joint of the moral framework justifying research. In this article, we review concerns about phase 1 trials as they have been framed in the bioethics literature, including undue inducement and coercion, unjust exploitation, and worries about compromised data validity. We then revisit these concerns in light of the lived experiences of serial participants who are income-dependent on phase (...) 1 trials. We show how participant experiences shift attention from discrete exchanges, behaviors, and events in the research enterprise to the ongoing and dynamic patterns of serial participation in which individual decision-making is embedded in collective social and economic conditions and shaped by institutional policies. We argue in particular for the ethical significance of structurally diminished voluntariness, routine powerlessness in setting the terms of exchange, and incentive structures that may promote pharmaceutical interests but encourage phase 1 healthy volunteers to skirt important rules.
